✅ 1. Acceptance of Terms

By downloading, installing, accessing, or using the HamariSociety mobile application or website ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you ("User") and HamariSociety ("Company", "we", "us", or "our").

If you do not agree to these Terms, you must immediately cease using the Service. Your continued use of the Service constitutes ongoing acceptance of these Terms.

âš ī¸ Important: These Terms include a limitation of liability clause and arbitration provisions. Please read them carefully before using the Service.

📱 2. Service Description

HamariSociety provides a digital platform for residential society management, including but not limited to:

  • Resident profile and directory management
  • Visitor entry and gate management
  • Maintenance fee billing and payment collection
  • Notice board and community announcements
  • Complaint and maintenance request tracking
  • Facility booking and scheduling
  • Community chat and messaging
  • Security alerts and reporting

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

👤 3. User Accounts

3.1 Registration

To use HamariSociety, you must create an account by providing accurate, current, and complete information. You agree to update this information to keep it accurate.

3.2 Account Security

  • You are responsible for maintaining the confidentiality of your login credentials
  • You must not share your account with any third party
  • You must notify us immediately at support@hamarisociety.in if you suspect unauthorized access
  • We are not liable for losses resulting from unauthorized use of your account

3.3 Eligibility

You must be at least 18 years of age to create an account. By registering, you confirm that you meet this requirement.

3.4 One Account Per Resident

Each resident unit may maintain one primary resident account. Multiple secondary accounts may be created for family members with admin approval.

You agree to use the Service only for lawful purposes. You must NOT:

  • Provide false or misleading information in your profile or communications
  • Harass, abuse, threaten, or intimidate other residents or staff
  • Post content that is defamatory, obscene, or violates any law
  • Attempt to gain unauthorized access to other accounts or our systems
  • Use the app for commercial advertising without permission
  • Upload or transmit viruses, malware, or malicious code
  • Reverse engineer, decompile, or disassemble the application
  • Collect data from other users without their consent
  • Use automated bots or scraping tools on the platform
  • Interfere with or disrupt the Service or its servers

Violation of these rules may result in immediate suspension or permanent termination of your account.

đŸ’ŗ 5. Payments & Fees

5.1 Maintenance Payments

Society maintenance dues and other charges are determined by your society's managing committee, not by HamariSociety. We provide only the payment collection infrastructure.

5.2 Payment Processing

  • All payments are processed through secure, third-party payment gateways
  • We do not store your complete payment card details on our servers
  • You agree to the terms of the payment gateway provider applicable to your transaction

5.3 Refund Policy

Refund eligibility for maintenance payments is governed by your society's rules. Platform service fees, if any, are non-refundable except where required by law.

5.4 Transaction Disputes

For disputes regarding payment transactions, contact your society's committee first. If unresolved, you may escalate to us at support@hamarisociety.in.

âš ī¸ Always verify payment amounts before confirming. HamariSociety is not responsible for incorrect amounts set by society administrators.

đŸ’Ŧ 6. User Content

6.1 Ownership

You retain ownership of content you create and post on HamariSociety (messages, photos, complaints, etc.).

6.2 License to Us

By posting content, you grant HamariSociety a non-exclusive, royalty-free license to host, display, and transmit that content as necessary to provide the Service.

6.3 Content Standards

All content posted must:

  • Be accurate and not misleading
  • Not violate any applicable laws or third-party rights
  • Be respectful and appropriate for a residential community
  • Not contain spam, advertisements, or promotions without approval

6.4 Content Removal

We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, to be inappropriate or harmful.

All intellectual property rights in the Service, including the app, website, logos, software, design, and content created by us, are owned by or licensed to HamariSociety.

  • You may not reproduce, distribute, or create derivative works from our content
  • Our trademarks and brand elements may not be used without written permission
  • The HamariSociety name and logo are registered trademarks

Any feedback or suggestions you provide may be used by us freely without any obligation to you.

🔒 8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.

âš ī¸ 9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties of uninterrupted, error-free, or secure access to the Service
  • Warranties regarding the accuracy or completeness of any content

We do not warrant that the Service will meet your requirements or that defects will be corrected. Use of the Service is at your sole risk.

🛑 10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HAMARISOCIETY SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to your account
  • Actions or omissions of third-party service providers
  • Any disputes between residents or between residents and the society committee

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

đŸšĒ 11. Termination

11.1 Termination by You

You may delete your account at any time through the app settings. Upon deletion, access to the Service will cease immediately.

11.2 Termination by Us

We may suspend or terminate your account immediately, without notice, if:

  • You violate these Terms or our Acceptable Use Policy
  • We are required to do so by law
  • We discontinue the Service entirely
  • Your society's subscription lapses

11.3 Effect of Termination

Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) shall survive.

âš–ī¸ 12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any dispute arising under or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

You agree to waive any right to a jury trial and any right to participate in class-action lawsuits against HamariSociety.

🔄 13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by:

  • Posting updated Terms within the app
  • Sending an in-app notification or email
  • Updating the "Last Updated" date above

Your continued use of the Service after changes are effective constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.
